Terms of Service

1. Acceptance of terms

By using Fizby ("the Service") you agree to these Terms of Service. If you do not agree, do not use the Service. These terms are governed by the laws of Australia.

2. What Fizby does

Fizby is a platform that allows organisers to create birthday Fizbys and collect contributions from guests via card payment. Fizby facilitates the collection of funds and charges a 5% platform fee on successful contributions.

3. Organiser responsibilities

  • You must provide accurate information when creating a campaign.
  • You are responsible for the campaign content you publish, including photos and messages.
  • You must use funds collected exclusively for the stated gift purpose.
  • You must not create campaigns for fraudulent, misleading, or unlawful purposes.
  • You must be at least 18 years of age to create a campaign.

4. Contributions and refunds

The minimum contribution is $10 AUD. All amounts are in Australian dollars.

Contributors are entitled to a full refund if a campaign is cancelled by the organiser or by Fizby. In all other circumstances, contributions are non-refundable once processed.

Fizby charges a 5% platform fee on all contributions. This fee is non-refundable.

5. Payouts

Payouts to organisers are processed after a campaign closes or reaches its goal. Fizby will contact the organiser to arrange the payout. Payouts are subject to identity verification and may be withheld if we have reason to suspect fraud or misuse.

6. Platform fee

Fizby charges a 5% platform fee on all contributions. This fee is deducted before the payout is made to the organiser. Stripe's payment processing fees are separate and also deducted from the contribution amount.

7. Prohibited use

You must not use Fizby to collect funds for any purpose other than the stated gift campaign, to impersonate another person, to conduct fraud, or to violate any applicable law.

8. Limitation of liability

To the maximum extent permitted by law, Fizby is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you will not exceed the platform fees paid in the 12 months preceding the claim.

9. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
